DENUNCIAN A LA POLICIA METROPOLITANA POR EXCESOS A GRUPO PROVIDA

La denuncia fue radicada por la Fundación Mas Vida en la Cámara Criminal y Correccional, a raíz de la detención indebida durante cerca de dos horas de un grupo de voluntarios de dicha organización, que se encontraban en las inmediaciones del Congreso Nacional cubriendo algunas pintadas vinculadas a la temática del aborto que se encontraban en la calzada frente al parlamento. Los voluntarios, entre los que se encontraban una menor de 12 años, líder de “Mas Vida teens”, y dos bebés de 6 meses y dos años respectivamente, fueron sorprendidos pasada la medianoche por media docena de móviles pertenecientes a la Policía de la Ciudad de Buenos Aires, uno de los cuales ingresó contramano por Av. Entre Ríos, en jurisdicción de la Comisaría 1 “B”, luego de lo cual se produjo la demora de los voluntarios, al ser abordados por 15 efectivos al mando de la Oficial Primero Romero, quienes luego de dar aviso a la fiscalía N° 12 a cargo del Fiscal Sebastián Fedullo, decían cumplir órdenes de la misma de detener a los demorados hasta tanto el fiscal resuelva qué hacer con ellos.
La denuncia recayó en el Juzgado Criminal y Correccional N° 56, a cargo del Juez Alejandro Litvack, ante quien deberá rendir cuentas el personal involucrado, acusado por aprehensión indebida ya que se detuvo irregularmente a cerca de ocho voluntarios, entre menores de edad y sus familiares, por la supuesta contravención del Art. 80, que corresponde a “ensuciar la vía pública”, algo así como la pena que correspondería aplicar a cada vecino que arroja un papel en la calle, pero sobre la cual no se puede detener ni aprehender.
“La policía no tiene poder para detener a un ciudadano por una supuesta contravención, como mucho puede limitarse a identificar al infractor y labrar el acta correspondiente, aunque no los vemos labrando actas cuando los abortistas ensucian o dejan pintadas en los comercios, pero si persiguiendo a los provida en lugar de detener a los delincuentes” informó a este medio el Dr. Raúl Magnasco, presidente de la ONG denunciante, y agregó “esperemos que la justicia tome cartas en el asunto y ordene a la policía a prevenir el delito, en lugar de perseguir familias que hacen el trabajo que debería hacer el gobierno de la ciudad”.
La detención tomó estado público desde el momento mismo en que se produjo la detención, ya que los voluntarios comenzaron a transmitir en vivo a través de las redes sociales de la Fundación los acontecimientos, en una serie de videos que se hicieron virales ante la indignación de miles de seguidores que comenzaron a llamar al 911 para denunciar a los policías por la desmedida acción ejercida.
Magnasco confirmó que, si bien mantuvo conversaciones con las autoridades de la Comisaría 1 B, no lograron llegar a un entendimiento para evitar que vuelvan a suscitarse eventos similares en el futuro, por lo que se radicó asimismo la denuncia en la Oficina de Transparencia y Control Externo de la Policía de la Ciudad, para que se encamine una investigación interna a los efectos de dar con el o los responsables del proceder, y ante el fracaso en el pedido de informe solicitado a la fiscalía N°12, desde la Fundación evalúan asimismo radicar la denuncia correspondiente al Consejo de la Magistratura, a los efectos de investigar si, como decía el personal policial, existió la orden del fiscal de detener durante dos horas a los voluntarios.
