LAS LEYES AMBIENTALES ESTÁN PERO FALTA QUE SE HAGAN CUMPLIR. EL CASO TESTIGO DE LAS PESQUERAS PATAGONICAS.

La Argentina esta adherida a tratados Internacionales para el Desarrollo Sustentable. Tanto la constitución Nacional, como la Ley General del Ambiente, las leyes provinciales y ordenanzas municipales, fueron creadas con el espíritu de proteger el ambiente, entendiendo que las personas y el entorno natural formamos parte de un todo, este marco legal es una herramienta administrativa que persigue el objetivo de que las actividades productivas, como la pesca, se realicen de manera armónica con la naturaleza , a lo largo de los años se han legislado normas de control para que los procesos se lleven a cabo respetando la vida en todas sus formas. Es por ello que se establecieron las condiciones para que las industrias gestionen sus residuos antes de arrojarlos al medio natural. Existe evidencia que en Puerto Deseado y Comodoro Rivadavia, las empresas pesqueras de capitales extranjeros se oponen a lo que es básico, fundamental y humano, volcando sobre el ambiente costero sus aguas residuales sin tratar adecuadamente. La actitud de estos grupos empresariales que actúan fuera de las normas ambientales, carece de ética y son faltos de compasión hacia la vida, poniendo en riesgo el bien jurídico protegido por las leyes de presupuestos mínimos de nuestra nación. Si la situación continua el resultado es: impunidad ante la contaminación del medio ambiente, no respeto al ecosistema y la afectación del derecho de todos a vivir en un ambiente saludable.
La industria pesquera es uno de los motores económicos principales de los municipios costeros de la Patagonia, esta actividad se desarrolla en regiones que poseen una riqueza en términos de biodiversidad y una belleza escénica únicas en el mundo. Por ello es necesario y urgente que coexista la producción y la protección del ambiente, poniendo fin a la afectación por el vuelco de aguas residuales del proceso del langostino, merluza, calamar y centolla que se extraen del mar argentino, procesan en tierra y comercializan mundialmente.
La persistencia de los volcados contaminantes por parte de la industria pesquera en las ciudades patagónicas de las provincias de Chubut y Santa Cruz, motivo la presentación de 2 denuncias penales. En las mismas se denuncia la presunta comisión de delitos contra el medio ambiente, por parte de las empresas pesqueras, que en vez de tratar sus residuos y para ahorrar dinero, proceden a volcar ilegalmente los mismos. En el caso de Comodoro Rivadavia al mar, mas precisamente, en la zona costera. En Puerto Deseado, directamente, sobre la playa y Ria de dicha localidad.
Hubo dos situaciones que despertaron reacciones e hicieron salir a la luz publica, el daño ambiental de la región.
Por un lado, la laguna del Corfo ubicada en la chubutense ciudad de Trelew, apareció con sus aguas teñidas de rosa y a pesar de lo que los funcionarios dijeron que ese color “desaparecería en pocas semanas”, pasados varios meses la situación se agravó y no solo el color rosado no desapareció, sino que ahora la laguna, presenta un color directamente morado. Por otro lado, la advertencia de ambientalistas de Puerto Deseado que encendieron las alarmas ambiental, ante el peligro de las colonias de pinguinos Magallanes y Penacho Amarillo, por el altísimo nivel de afectación de la Ria de Deseado, lugar en la que las pesqueras realizan sus vuelcos ilegales.
Esas situaciones han sido la antesala de las denuncias judiciales. Las empresas pesqueras apuntadas en las presentaciones son:
Argenova SA (Grupo Pescanova), Arbumasa SA, Pesquera Santa Cruz SA, Empesur SA, Pesquera Deseado SA, Viera Argentina SA, Explotación Pesquera de la Patagonia SA (Grupo Veraz), Cooperativa de Vivienda y Trabajo el Mar Azul Ltda.
Además, se señala la presunta responsabilidad de la Dirección Provincial de Recursos Hídricos dependiente del Consejo Agrario, la Secretaria de Estado de Ambiente de Santa Cruz y el Municipio de Puerto Deseado (Subsecretaria de Ambiente).
Una de las denuncias se presento ante la (UFIMA), Unidad Fiscal para la Investigación de Delitos Contra el Medio Ambiente y en este caso, es un vecino de Puerto Deseado, el Denunciante. En el otro caso, la denuncia fue presentada en Comodoro Rivadavia ante la justicia provincial y surge a raíz de las intervenciones y sanciones por incumplimiento a la ley ambiental, aplicada oportunamente por el Ministerio de Medio Ambiente provincial, a la empresas pesqueras.
Ambas presentaciones son para que se investigue el posible delito de daño ambiental y en ambos casos, por la incorrecta gestión y volcado indebido de efluentes a un cuerpo liquido receptor.
Para el caso de Puerto Deseado la denuncia ofrece como prueba los resultados del análisis de muestras tomadas de los vertidos hacia la Ria Deseado realizados por un laboratorio y de la cual surge que existe un exceso de materia orgánica, grasas y aceites y otros componentes con valores de concentración fuera de los límites que permite la Ley.
Profesionales en ciencias ambientales de Puerto Deseado, vienen advirtiendo esta situación para el caso de la Ria de Puerto Deseado la misma, presenta una tonalidad en el agua anaranjada y según la presentación “los resultados de los análisis de laboratorio, que se realizaron sobre las muestras de los efluentes industriales pesqueros, que se vuelcan en el agua y la costa de la Ria superan los límites permisibles establecidos en la norma de los siguientes parámetros:, DBO5 (demanda biológica de oxigeno), DQO (demanda química de oxigeno), grasas-aceites, solidos sedimentables y nutrientes además las muestras analizadas arrojaron valores alarmantes de bacterias coliformes, lo que resultan una prueba química irrefutable que habla del estado de afectación del agua y resulta gravoso para el equilibrio del ecosistema del lugar”, se supo que se sostiene la presentacion.
Las consecuencias que derivan de esta situación “se traducen en posibles infecciones por microorganismos patógenos, modificación de la vida acuática por disminución del oxígeno disuelto, generación de olores desagradables y alteraciones estéticas por la presencia de espumas, turbidez y color en el cuerpo de agua receptor de los efluentes”, se conoció que dice la denuncia.
La afectación de la Ria por el volcado ilegal de las empresas pesqueras que buscan evitar el costo (bajísimo) del tratamiento de sus residuos, tal como lo exige la ley es tal que según trascendió en el mes de Agosto, la Secretaria de Estado de Ambiente de Santa Cruz junto con la Subsecretaría de ambiente Municipal fiscalizo la tareas de muestreo de efluentes en las plantas pesqueras de dicha localidad, obteniendo resultados que evidencian la inexistencia y/o deficiencia de tratamiento del agua residual producida en los establecimientos en incumplimiento a lo que obliga la ley.
Respecto al volcado sobre la Ria Deseado, desde el Municipio y la Provincia justifican su inacción por cuestiones de jurisdicción, debido a que existe también responsabilidad en el control de Recursos Hídricos de la Provincia, quienes permiten que se continue con esta conducta delictiva, es importante mencionar que estas empresas explotan los recursos naturales de la región hace ya más de 30 años
